Since as you said, they are failing to enforce their ToS, you need legal ground to launch from, so here it is. The ToS is a legally binding contract between you and NC...and failing to meet their obligations could be construed as a breach of contract. However, getting this to a court and finding people to pursue the legal action is going to be difficult at best.
